These Conditions of Use (“Terms”) apply to your use of the Priority Towing website at prioritytow.com (the “Site”). The Site is operated by Priority Towing (listed on Google as Priority Towing Service), 3242 S 36th St #2, Phoenix, AZ 85040. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Website use only
These Terms cover the Site only. They are not a towing, storage or service contract. Any towing, roadside, transport or storage service we provide is governed by the agreement, invoice or tow paperwork for that job and by applicable law.
Rates and police or nonconsensual tows
Rates on the Site are general information and can change. Your actual charges depend on your vehicle, location, the service needed and the conditions at the scene. We will quote what we can over the phone before service begins. Rates and release rules for police-requested and other nonconsensual tows, including storage charges, are set or limited by applicable Arizona law and by the rates in our agreements with each law enforcement agency or municipality. No guaranteed arrival times
We work to reach every call as quickly and safely as we can, but traffic, weather, road closures and call volume are outside our control. Nothing on the Site is a promise that a truck will arrive within a certain time.
Using the Site
You agree not to misuse the Site. For example, you will not send false service requests or false locations, try to break into or disrupt the Site, send spam or harmful code, or use the Site for anything unlawful. Information you send through our forms must be accurate to the best of your knowledge.
Third-party links and services
The Site links to and embeds services run by others, such as Google Maps, Towbook, Jotform, towlot.com and review sites like Google, Yelp, Facebook and YellowPages. We do not control those services and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.
Intellectual property
The Site’s text, photos, logos and design belong to Priority Towing or are used with permission. You may view and print pages for your own personal, non-commercial use. You may not copy, republish or use our name, logo or photos for any other purpose without our written permission. Reviews shown on the Site belong to their authors and are shown as posted on the review platform.
Disclaimer
We try to keep the Site accurate and up to date, but it is provided “as is” and “as available.” To the fullest extent allowed by law, we make no warranties of any kind about the Site, including that it will be error-free, uninterrupted or free of viruses. Information on the Site is not legal advice.
Limitation of liability
To the fullest extent allowed by law, Priority Towing will not be liable for any indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of, or inability to use, the Site or any linked site. This section applies to the Site only. It does not limit any rights you have under the law or under a service agreement for towing or storage work.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute about the Site or these Terms will be brought in the state or federal courts located in Maricopa County, Arizona, and you agree to the jurisdiction of those courts.
Privacy
Our Privacy Policy explains how we handle information sent through the Site.
Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they last changed. Changes take effect when they are posted on this page. If any part of these Terms is found unenforceable, the rest stays in effect.
